Mediation in the Czech Republic

DISERTAČNÍ PRÁCE V ANGLICKÉM JAZYCE Mediation in the Czech Republic A doctoral thesis represents an evaluation of the fulfillment of the legislator's predicted objectives and expectations placed into the adopted legislation of mediation after ten years of its effectiveness in the legal system of the Czech Republic. The text is divided into thirteen chapters, which gradually address the main topics related to the new civil law regulation of mediation. The first chapter briefly describes the development and existing mediation regulation in the Czech Republic. Next, there are identified the main points of research interest, which are elaborated in more detail in the following chapters. The attention is successively paid to the topics of (i) the duplex legal regulation of mediation, (ii) the performance of mediation outside the framework of the Mediation Act, (iii) the presumed benefits and guarantees associated with mediation under the Mediation Act, (iv) confidentiality of the subjects involved in mediation, (v) the remuneration and reimbursement of the mediator's expenses, (vi) prerequisites for the registered mediator profession, (vii) special legislation for mediator-attorneys, (ix) regulation of the first ordered meeting with a registered mediator, (x) the statute of limitations, (xi) direct...

Game as a means of developing mediation

Title of the thesis Game as a means of developing mediation Abstract in English This diploma thesis focuses on the theme of game as a means of developing mediation. In the theoretical part it discusses the notion of mediation, its concept in the Common European Framework of Reference for Languages and its Companion Volume, the means and forms of mediation, the importance of mediation in foreign languages teaching. Major emphasis is placed on theme of mediation activities (mediation communication, mediating a text, mediating concepts). Moreover, the theoretical part concerns the issus of games, their definition from a didactic point of view and points to the mutual aspects of games and mediation. In the practical part, it focuses on analysis of specific games developing mediation. The games are classified according to what mediation activity they develop. For each game it is described minutely how it develops the given mediation activity. These games could be used as teaching materials for teachers or be an inspiration for their own formation. This bachelor's thesis deals with the problematics of the telecommunication. It describes basic elements of telecommunication networks and focuses on the communication using different interafces between the elements. This process is also known as mediation. Software tools responsible for data transfers between the network elements are rapidly evolving due to a growing functionality of the telecommunication networks. The maintenance costs are considerable and growing as well. This thesis aims to reduce these costs using automation of regression testing processes in order to produce more reliable products.

Alternative Dispute Resolution in Civil Disputes between Patients and Heathcare Providers Abstract This thesis is centered on addressing the use of alternative dispute resolution (ADR) methods concerning conflict resolution between healthcare providers and patients in the Czech Republic. The initial chapter delves into the substantive aspects of ADR in civil disputes within the healthcare sector. The first subchapter provides a brief overview of the civil liability of healthcare providers. Subchapter two explores the doctor-patient relationship, shedding light on some of its problematic facets that can lead to conflicts. Chapter three focuses on ADR. It not only defines the concept of alternative dispute resolution but also employs charts to compare mediation and litigation, highlighting the potential of ADR. The subsequent subchapter outlines the characteristics of ADR. While a complaint isn't strictly considered an ADR method, it plays a crucial role in the healthcare sector, acting as a precursor to the ADR process. Thus, the following section delves into the complaint mechanism and the individuals responsible for handling complaints, including hospital ombudsmen, lawyers, and the Public Defender of Rights. The text is divided into two main sections. The first section deals with topics related to the Act on Mediation and the Decree on Examination and Mediator's Remuneration. The second part is concerned with the consequences and connections that are not explicitly regulated by such legislation. In the specific chapters, the expectations of the legislator and subsequent opinions arising from ten years of expert discussion are presented. The author's own conclusions formed using appropriate methodological procedures, especially analytical, normative and empirical approach follows. The theoretical part describes mediation - the term mediation, basic principles, objectives, advantages and definition of mediation according to Czech legislation, mediator - the role of the mediator, his main tasks and skills. It also describes the process of mediation, its phases and possible difficulties, that may arise at certain stages of the process. The bachelor thesis presents suitable and unsuitable cases for mediation.At the end of the theoretical part, the bachelor thesis is devoted to mediation in social work. It introduces the application of mediation and methods of mediation, the application of mediation in social work is presented and the target groups of social work are introduced. In the practical part, I chose a qualitative method to collect data through a semi- structured interview. The aim of the Bachelor's thesis was to find out, from selected social workers of Dobříš and Nový Knín regions, the awareness of mediation and its possible use as a method of social work.

Mediation and its use in labour relations

67 Mediation and its use in labour relations Abstract In this thesis I deal with the issue of mediation and its use in the labour relations. Mediation is one of the alternative ways of dispute resolution, as the labour law is a sphere in which disputes often occur, and it is therefore desirable to look for other effective ways of resolving them than court proceedings. For this reason, in my thesis I focus on the institution of mediation and the possibilities of its use in the field of labour law. I focus primarily on the use of mediation in employment relations of an individual nature and reflect on its legal regulation in Act No. 202/2012 Coll. In the first chapter, I provide a detailed description of mediation, its objectives, and principles. This is followed by the description of historical development in the world, in Europe and in the Czech Republic. Then I discuss the legal regulation, describe mediation trends, and list the areas in which mediation is applied. The second chapter is devoted to labour disputes. As a criterion for their division, I use the labour relationships because of them employment disputes arise.
